Pennsylvania Pay Transparency Law Proposed

Pennsylvania Pay Transparency Law Proposed

On February 12, 2025, Pennsylvania became the eleventh state this year to propose a pay transparency law. If HB 560 is passed in its current form, Pennsylvania employers with fifteen (15) or more employees will be required sixty (60) days after passage to:

  • Provide pay ranges – or at least disclose a salary minimum – to candidates offered a new role or an internal promotion or transfer;
  • Annually notify current employees of their pay range in writing; and
  • Ensure transparency for jobs that require substantially similar skill, effort and responsibility.

Unlike pay transparency laws in many other jurisdictions, HB 560 would not require the inclusion of salary ranges in job postings.

United States jurisdictions with pay transparency laws already in effect include California, Colorado, Hawaii, Illinois, Maryland, Minnesota, New York State (and New York City), Washington DC and Washington state. The states that have proposed pay transparency laws so far in 2025 include Alaska, Connecticut, Indiana, Iowa, Kentucky, Maine, Missouri, Montana, Oregon, and Virginia. In addition, pay transparency laws will take effect this year in New Jersey (June 1, 2025), Vermont (July 1, 2025) and Massachusetts (October 29, 2025).

Neighboring New Jersey’s version of pay transparency will require employers to provide the “hourly wage or salary, or a range of the hourly wage or salary” in postings for new jobs or transfer opportunities. The law also will require employers to make “reasonable efforts” to advertise promotion opportunities to all current employees “in the affected department or departments of the employer’s business.”

Employers should consult with experienced human resources professionals and/or labor and employment counsel with any questions regarding these new employment laws and any required changes to employer policies and practices.  For all MEA members, the Hotline is available to provide this assistance. For MEA Essential and Premier members, a Member Legal Services attorney is available for additional consultation.
